Terms and Conditions: Course Registrations

NLvoorelkaar is the overarching, national website of a network of local websites for supply and demand of voluntary commitment and neighborly assistance. An overview of the affiliated websites can be found at NLvoorelkaar/familie.

This page describes the general terms and conditions of the course module (hereinafter: general terms and conditions) of NLvoorelkaar that apply if the course module is used.

The following conditions and all applicable legal rules apply to NLvoorelkaar's services. The general terms and conditions contain important information about rights and obligations when using the Course module.

Article 1. Definitions

The following definitions are used in these general terms and conditions, both in the singular and in the plural.

  1. Account: the registration of the Course Provider in the Course Module.
  2. Student: the natural person who registers for a Course by using the Course module.
  3. Course: the course that the Course Provider places on the Website.
  4. Course provider: the (registered) natural or legal person who makes Courses available by means of the Course Module that can be followed by Course participants.
  5. Course module: the module offered by NLvoorelkaar on the Website where the Course Provider can place Courses and for which the Student can register.
  6. User: Student and/or Course Provider.
  7. Local administrator: natural or legal person who manages the local Website.
  8. NLvoorelkaar: the private company with limited liability Social Care Network BV, with its registered office in (4814 DC) Breda at Reduitlaan 33 and registered in the trade register of the Chamber of Commerce under number 24404969, which has developed and operates the Course Module.
  9. Website: this website (www.nlvoorelkaar.nl) and linked websites of NLvoorelkaar or partner websites on which the Course Module can be used.

Article 2. General

  1. These general terms and conditions apply to:
    a. Course Provider, as long as the Course Provider is registered and/or has placed a Course in the Course Module;
    b. Student as long as Student is registered for a Course.
  2. By registering for a Course, by registering as a Course Provider or by placing a Course on the website, the User accepts these general terms and conditions and agrees to them.
  3. NLvoorelkaar is at all times entitled to amend or supplement these general terms and conditions. Changes are published in the Course module. After publication of the changes, the User is given a period of 30 days to reject the changed terms and conditions. After 30 days, the User is deemed to agree with the amended terms and conditions.
  4. Deviations from the general terms and conditions are only valid if they have been expressly agreed in writing or by e-mail between NLvoorelkaar and the User.
  5. NLvoorelkaar expressly rejects any general terms and conditions of the User.
  6. If and insofar as any provision of these terms and conditions is void or voided, the remaining terms and conditions will remain in full force and effect. NLvoorelkaar will then establish a new provision to replace the void/nullified provision, whereby the intent of the void/nullified provision will be taken into account as much as possible.

Article 3. Services

  1. NLvoorelkaar offers the Course Module on the Website where Course Providers and Students can get in touch with each other for a Course. NLvoorelkaar only has a facilitating role in this respect and can therefore not guarantee that supply and demand are brought together and that course placements and registrations are properly processed.
  2. NLvoorelkaar is not responsible for:
    a. incorrect, incomplete, inappropriate, not current and unlawful information in the Course Module (including the information provided by Users);
    b. the uninterrupted operation of the Course Module;
    c. viruses, trojans and other errors and/or defects in the Course Module;
    d. unlawful use of the Course Module by third parties;
    e. registrations by Students;
    f. the quality, safety and/or legality of the Course
    g. agreements and communications between Users, and;
    h. the obligations that Users enter into with each other, including the execution of the Course.
  3. NLvoorelkaar is at all times entitled to adjust and/or suspend and/or terminate (the content of) its services. In that case, NLvoorelkaar will make reasonable efforts to inform the User of this in a timely manner.
  4. NLvoorelkaar is authorized to engage third parties (such as a Local Manager) to provide its services.
  5. NLvoorelkaar only offers support in the use of the Course Module insofar as the User is located in a municipality with which NLvoorelkaar has concluded an agreement for the delivery of the Course Module.

Article 4. Course provider

  1. Course Provider can place a Course in the Course module after creating an Account.
  2. Course provider must be at least 16 years of age. By creating an Account in the Course Module, the Course Provider declares to be 16 years of age or older.
  3. NLvoorelkaar is entitled to delete an Account without stating reasons. If the Course Provider does not use his Account for more than 12 months, his Account will be deleted. Before NLvoorelkaar proceeds to delete an Account, it will inform the Course Provider of this.
  4. Course provider is responsible for choosing a secure password when creating an Account.
  5. The Course Provider's login details are confidential and personal. Course provider ensures safe storage and protection of his login details.
  6. NLvoorelkaar is entitled to change the password if this is necessary in the interest of the functioning of the Course Module.
  7. Course Provider warrants that it is authorized to post Courses in the Course Module.
  8. Courses must be posted stating the information requested in the Course Module and in accordance with the instructions stated in the Course Module.
  9. Course provider guarantees that all data it provides in the context of the Course Module and the Course (including course information):
    i. are complete, accurate, current, lawful and in accordance with applicable laws and regulations, and;
    ii. may be used and published by NLvoorelkaar in the context of the Course Module.
  10. In any case, no material may be placed in the Course Module:
    a) that refers to the provision of illegal services or services that may cause harm to others in any way;
    b) with which other Users are treated unfairly;
    c) that harms the interests and/or reputation of NL for each other;
    d) which infringes intellectual property rights, privacy rights or which violates other rights of NLvoorelkaar or third parties;
    e) that is contrary to morality or good taste, is violent or incites violence or hatred against others;
    f) in which mention is made in any way of or reference is made to another website that competes with the Course Module or a comparable website.
  11. NLvoorelkaar reserves the right to monitor, check, refuse and/or remove the information provided by the Course Provider, without being liable for damages to the Course Provider.

Article 5. Student

  1. Student registers for a Course in the Course module by filling in an registration form. The Student does not need to register for an account.
  2. The student must be at least 16 years old. By enrolling in a Course, the Student declares to be 16 years of age or older.
  3. Student warrants that all information provided for Course enrollment is complete, correct, current, lawful and in accordance with applicable laws and regulations.
  4. Student warrants that he/she is authorized to enroll in and attend the Course.
  5. In any case, no text may be stated on the registration form:
    a) which refers to the provision of illegal services or services that may cause harm to others in any way;
    b) with which other Users are treated unfairly;
    c) which harms the interests and/or the good name of NL for each other;
    d) which infringes intellectual property rights, privacy rights or which violates other rights of NLvoorelkaar or third parties;
    e) which is contrary to morality or good taste, is violent or incites violence or hatred against others;
    f) in which mention is made in any way or reference is made to another website that competes with the Course Module or a comparable website.
  6. NLvoorelkaar reserves the right to check, refuse and/or remove the information provided by the Participant, without being liable to pay compensation to the Participant. NLvoorelkaar will, where appropriate, inform the Student about such action.

Article 6. Privacy

  1. NLvoorelkaar's privacy statement for course registrations applies to the processing of personal data in the context of the Course module.
  2. Users may only use (personal) data that they obtain through the Course module for providing and/or attending the Course.

Article 7. Maintenance

  1. NLvoorelkaar is entitled to (temporarily) put the Course Module out of use or to limit its use in order to carry out maintenance and adjustments, or have it carried out, without being liable for compensation to the User. NLvoorelkaar will inform Users in a timely manner where possible about maintenance and/or adjustments that are being made.

Article 8. Intellectual property rights

  1. All intellectual property rights with regard to the Course Module rest exclusively with NLvoorelkaar, its licensors or suppliers.
  2. Without NLvoorelkaar's prior written consent, Users may not, in any way whatsoever, make the Course Module or any content thereof available to third parties, reproduce, distribute, transmit, or incorporate it into any other document or material.
  3. Course provider guarantees that the information placed by him in the Course module, including course information, does not infringe (intellectual property) rights of third parties.

Article 9. Exclusion

  1. NLvoorelkaar may deny the User access to the Course module if the User acts contrary to these general terms and conditions.
  2. NLvoorelkaar makes the Course Module available locally by concluding agreements with Municipalities. NLvoorelkaar can deny Users in municipalities access to the Course Module without an agreement.

Article 10. Force majeure

  1. NLvoorelkaar is not obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure also includes a non-attributable shortcoming on the part of suppliers and/or other third parties that NLvoorelkaar uses.

Article 11. Liability NLfor each other and indemnifications

  1. NLvoorelkaar excludes its liability towards the User for all damage suffered by the User as a result of using the Course module, all in the broadest sense of the word, with the exception of cases where there is intent or deliberate recklessness on the part of NLvoorelkaar .
  2. Insofar as the exclusion of liability referred to in paragraph 1 would be without legal validity on any ground whatsoever, NLvoorelkaar limits its liability towards the User to the amount that the Student owes to the Course Provider for taking the Course.
  3. The course provider indemnifies NLvoorelkaar against any claim for compensation and/or any other claim from third parties that arises from or is related to;
    a) infringement of intellectual property rights, and;
    b) unlawful use of an Account or login details.

Article 12. Referrals

  1. The Course Module contains references to third-party websites. NLvoorelkaar has no control over these websites and is not responsible for their content and/or the policy pursued (including the privacy policy).

Article 13. Security

  1. NLvoorelkaar makes every reasonable effort to protect its systems against loss and/or any form of unlawful use. NLvoorelkaar takes appropriate technical and organizational measures in this regard, in view of the state of the art.

Article 14. Notification of Infringement

  1. Illegal information in the Course Module can be reported to NLvoorelkaar, by e-mailing [email protected] If the report meets the requirements set by NLvoorelkaar, NLvoorelkaar will assess the report. If the offending material is manifestly unlawful, NLvoorelkaar will remove it within a reasonable period of time.

Article 15. Disputes

  1. Dutch law applies to these general terms and conditions. Applicability of the Vienna Sales Convention 1980 is excluded.
  2. Disputes related to these general terms and conditions and/or the Course Module will be submitted to the competent court in the district of Zeeland-West-Brabant, location Breda.
